Modification of an older declaration of property division – checklist

Ensure that your declaration of property division includes everything necessary.

Cover page and introduction

Front Page

The following information must be included:

  • Address (name and number)
  • Municipality
  • Property number
  • Unit number (buildings are generally registered as one unit)

Introduction (change from an older declaration of property division)

Explain why a new declaration of property division is being made.

What is being changed from the older declaration of property division?

Specify:

  • Ownership of spaces. If the ownership of spaces is being changed, a transfer of ownership must also be registered.
  • Ownership numbers (space numbers of properties) and unit numbers.
  • Consolidation of units.
  • Increase in properties and from which properties the new ones are being created.
  • Consolidation of property numbers. Which properties remain and are dropped in the consolidation.

Indicate when the recorded declaration of property division is to be nullified and refer to its record number.

Basis

Name of the author of the declaration of property division and identification number with reference to:

  • Act No 26/1994 on Multi-Owner Buildings with later amendments
  • Regulation on declarations of property division and calculation of percentage numbers 910/2000
  • IST 50:1998
  • Registration rules of the FMR and Building Commissioner from 2005
  • Regulation on the registration of addresses 577/2017
  • Act on the Registration and Evaluation of Real Estate 6/2001
  • Approved main drawings upon which the declaration is based
  • Recorded authorizations, rights, and obligations

Number of pages of the declaration.

Number of pages of attachments along with explanations.

Deviations

If there are deviations from approved master plans and/or approved registration table, a deviations section must be created in the declaration of property division in consultation with the Building Commissioner, in addition to drawings that explain the deviations.

Plot

The following information must be included:

  • Ownership form of the plot
  • Term of the land lease agreement if the plot is leased, with reference to the record number
  • Use and size of the plot. Describe the share of all units in the plot if more than one. Specify the relationship between units on the plot and possibly on other plots
  • Number of parking spaces on the plot and ownership (e.g., parking in front of a garage)
  • Special rights/obligations, provisions of planning conditions, and parts of the plot e.g., under verandas if owners have agreed on such

The following information must be included:

Building right, if it exists, according to Article 28 of the Act on Multi-Owner Buildings.

If there is a building right on a plot that is to receive a property number, you need to have an estimated/known share in the plot due to it and mention it in the description of properties in the same way as is done with other properties.

  • Main building materials
  • Number of floors and year of construction according to documents
  • Total size
  • Stated floor area and gross volume of units according to the registration table

Describe the limited common area, spaces and equipment, and to which property parts the common property belongs; special rights/obligations.

Energy measurement

Description of heating costs

Describe the division of heating costs.

Specify:

  • Number of district heating meters, their location, and entry point in the house.
  • Number of cold water meters if applicable, their location, and entry point in the house.
  • Cost division for private properties and common areas if the meter is shared. Include a percentage sheet from the registration table as an attachment.

Description of electricity costs

Specify:

  • Number of electricity meters, their location, and entry point in the house.
  • Estimated electricity consumption if needed. Describe the cost division for common area and costs between properties if applicable.

Obligations

If there are obligations on properties or in the lease agreement for the plot, it should be mentioned here.

Refer to the record number of the document if obligations are registered

Description of private properties

Describe the private property and use the "description" worksheet from the registration table that includes a description of the private property, property number, and ownership number of properties, published total size, and detailed sizes of spaces, as specifically defined in the registration table.

Specify in the description the address of the property if the property has a private entrance. Information on the address can be obtained from the Building Commissioner.

In the description, include the percentage numbers of the private property in the unit, entire building, plot, heating, and the limited common area if applicable.

Confirmation

The following information must be included:

Name and identification number of the author.

Provide for the following signatures, if applicable:

  • Signature of the recorded holder of title and the contract purchaser
  • Signature for the entire building
  • Signature of the Building Commissioner
  • Signature of the housing association

Attachments

  • Approved master plans (endorsed/stamped along with approved registration table (summary sheet from table)
  • Percentage numbers from the worksheet
  • Identification of spaces with space numbers and colors (demarcation of spaces according to spaces in the registration table)
  • Deviation drawing and/or registration table with deviations (with the approval of the Building Commissioner)
